Aure Mai IyakaNa farko: Hanin da Umar ya yi wa auren mutu'a yana karfafa wa ne ga hukuncin da yake manzon Allah ya boye shi bai bayyana wa mutane ba, har sai da Umar ya hau halifanci sai ya shelanta wa mutane. Tafsirur Razi, 2/167. Mai tafsirin yana nuna cewa; Ya tabbata ne gun Umar cewa; an shafe ta a lokacin Annabi (s.a.w) don haka shi ma sai ya shelanta hakan, wato; kamar ka ce; Annabi ya ba wa Umar hukuncin ne da zai shelanta shi idan ya kasance halifa, sai kowa ya jahilci hukuncin sai Umar ne kawai ya sani!. Alminhaj, fi sharhi sahih Muslim, hashiyyar Kasdalani: 6 / 128. Sai dai wannan tawili da yake nuna kin gaskiya a fili yana rushewa da dalilai kamar haka: Umar da kansa ya ce: Halal ce a lokacin manzon Allah (s.a.w), amma shi ya hana, kuma zai yi ukuba a kan hakan. Hada da cewa da Umar yana son shelanta wannan lamari ne, da ya fada tun farkon da ya zama halifa, amma sai karshen rayuwarsa ya fada cewa; ya haramta. Sannan kuma dukkan sahabbai hatta da dansa ba su yarda da haramcin da ya yi ba, kuma sun nuna cewa; Ba yadda za a yi haramcin Umar ya kasance hujjar shafe sunnar manzon Allah (s.a.w), sannan sai a yarda da shi. Tarih Dabari: hawadis 23 H. 4/225. Don haka a fili yake cewa Umar da kansa ya shelanta cewa; Shi ne ya haramta, kuma sahabbai masu yawa sun musanta masa wannan haramcin ba su karba ba. Sai dai wasu suna cewa; Tun da dai shi halifa ne, kuma sunnar halifofi an samu umarnin riko da ita, don haka sai mu yi riko da wannan haramcin na Umar!. Wadannan mutanen sun ga hadisan da aka ruwaito na haramcinta a lokacin manzon Allah (s.a.w) daga Samura bin Ma'abad ba su inganta ba, kuma sun ci karo da hadisan manyan sahabbai da ayyukansu tun lokacin manzon Allah (s.a.w), don haka sai suka koma kan wancan tawili na yin riko da sunnar halifofi. Duba raunin maganar haramcin auren mutu'a a lokacin manzon Allah (s.a.w) game da ruwayar Sahih Muslim a cikin Littafin: Tahzibut Tahzib: 6/349. A nan sai mu ce: Babu yadda za a yi aikin halifan manzon Allah (s.a.w) ya saba da nasa, domin halifa yana kare abin da manzon Allah (s.a.w) ya bari ne, wannan ne ma daya daga cikin manyan dalilan da suke nuna cewa; Umar ba ya daga cikinsu. Kuma wannan lamarin ya sanya Shi'a cewa: Mun karbi maganarsa a kan cewa; Allah da manzonsa sun halatta, amma kuma mun yi watsi da nasa hukuncin yayin da yake cewa: Amma ni na haramta. Sannan kuma halifofin manzon Allah (s.a.w) ba su ne guda hudu ko biyar ba, halifofinsa su ne alayensa (a.s) da ya hada su wuri guda da Kur'ani ya shelanta mana wajabcin riko da su, wanda na farkonsu shi ne imam Ali (a.s) na karshensu kuwa imam Mahadi (a.s). Wasu kuwa suna cewa: Umar ne kawai ya san haramcin auren mutu'a ban da sauran sahabbai, don haka sauran sahabbai kamar su imam Ali (a.s), da Abdullahi dan Mas'ud, da Ubayyu dan Ka'abu, da Jabir dan Abdullah, da Abdullahi dan Abbas da makamantansu masu yawa, ba su san Annabi (s.a.w) ya haramta ba ne, don haka sai Umar ya shelanta a karshen rayuwarsa![26]. Wannan magana ta fi kowacce rauni da nuni zuwa ga barnataccen tawili maras madogara da kan gado, hada da cewa; Umar yana cewa: Ni ne na haramta bayan ya shelata cewa; Allah da manzonsa sun halatta. Masu wannan ra'ayin suna kokarin ganin sun mayar da haramcin zuwa ga manzon Allah ne, don haka sai suka fada cikin dimuwar rashin sani, da ayyana takamaimai wace shekara, kuma a wane lokaci ne aka haramta ta. Idan mun duba wadannan madogara da zamu kawo a kasa, zamu ga sun yi maganganu masu yawa da karo da juna, kan yaushe ne aka haramta auren mutu'a bisa shekaru mabambanta, domin dai su kare wancan haramcin da samar masa mafuta: Muna iya duba; Fathul bari fi sharhi sahihul bukhari: 9/138, da Zadul Ma'ad Fi Hadyi Khairil Ibad: 2/184 Wasu su ce: Shekarar Hajjin bankwana, wasu kuwa, a yakin Hunain, wasu kuma a yakin Audas, wasu kuwa a Umarar ramuwa, wasu kuma a yakin Haibar, da masu ra'ayin yakin Tabuka, da masu cewa; a Bude Makka. Da wannan ne suka jingina wa shari'a wasa da hankulan mutane, sai suka so su hada dukkan wadannan maganganun, sai su ce; an halatta a nan, sai kuma aka haramta, sai aka sake halattawa, kuma aka sake haramtawa, haka aka yi ta yi har sau bakwai! Ga Ibn Kayyim yana cewa: Ba a taba samun hukuncin shari'a da aka haramta kuma aka halatta shi har sau biyu ba, (balle sau bakwai)! Zadul Ma'ad fi Hadyi Khairil Ibad: 2 / 184.
