HUKUMCE-HUKUMCEN SHARI’A

Ana iya takaita… na ka’idoji da asasai da wadannan abubuwa masu zuwa, su ne ababen da suke da tasu irin gudummawar wajen kamalar dan’Adam na daga kokarin kansa kamar yadda muka sani, sai dai duk da haka akwai bu’udi na zamantakewa kuma.

Na Farko: Hukumce-Hukumcen Shari’a Da Na Gama-Gari

Na farko …. na hukumce-hukumcen shari’a da na gama gari (hukumce-hukumcen da jama’a suka tafi a kansu da ake ce ma urf da harshen larabci) da za mu iya ganinsu – kamar yadda muka nuna a baya – cikin misalin cika alkawurra da yarjejeniyoyin da aka kulla, rike amana, halartar jana’iza da sallolin jam'i, da tarurruka na mutane, gaisuwar mara lafiya, amsa sallama, ba da amsa ga wasikar da aka aiko wa mutum da dai sauransu.

Baya ga haka, muna iya ganin wajibai na gaba daya da muka yi ishara gare su a yayin da muke magana kan ginin zamantakewa, misali ka’idar wajibcin taimakekeniya tsakanin musulmi, wajibcin mai da hankali kan al’amurransu, wajibcin aiki kafada-kafada, wajibcin yin nasiha a tsakani, wajibcin umarni da mai kyau da hani da mummuna, kyautatawa makwabtaka, yin shawara tsakaninsu da dai sauran wajibai da nauye-nauye na gaba dayan al’umma.

Kulada Matsayi na Wajibi

Bugu da kari kan dukkan wadannan, akwai kuma wasu hakkoki da wajibai da ababen da aka haramta a mahanga ta shari’a da kuma hukumce-hukumcen gama-gari na jama’a da yawan gaske, ga wasu daga cikinsu:

1 – Wajibi ne mutum ya kare sirrin dan’uwansa musulmi cikin alaka ta zamantakewa, a lokacin da ya ji wani abu daga gare shi a taro ne ko kuma ya gaya masa. Akwai ruwayoyi da aka ruwaito kan rike amana a yayin zama, duk da cewa akwai ababen da aka kebance na musamman kan wannan yanayi.

Daga Abi Ja’afar (a.s) yana cewa: “Manzon Allah (s.a.w.a) ya ce: (a yi) zaman taro cikin amana[1]”.

Daga Abi Abdillah (a.s) yana cewa: “Zama taro cikin amana, ba ya halalta ga wani ya fadi wata magana da dan’uwansa ke boyewa har sai da izininsa, sai dai idan ya kasance abin dogaro ko kuma alheri ne[2]”.

Manzon Allah (s.a.w.a) yana cewa: “A zauna cikin taro da amana sai dai tarurruka uku kawai: taron da aka yi don zubar da jinin da bai halalta a zubar da shi ba, ko kuma taron halalta wani farji na haramun, ko kuma taron da za a halalta dukiyar haramun ba tare da hakki ba[3]”.

2 – Kwadaitarwar shari’a kan cika alkawurra a gefen wajibcin cika rantsuwa da yarjejeniyoyin da aka cimma.

Abu Abdullah (a.s) yana cewa: “Manzon Allah (s.a.w.a) ya ce: wanda ya yi imani da Allah da Ranar Lahira ya cika alkawari idan ya dauka[4]”.
